  • Purpose

  • These general terms and conditions of sale apply without restriction or reservation to all online sales offered by the company HYBRÉ on the website https://cenee-paris.com ("the Site").

    The Site is an e-commerce platform hosted by Shopify, allowing individual consumers ("Buyers") to purchase cosmetic products (including makeup, skincare, and various accessories) offered for sale on the Site ("the Products").

    The purpose of these general terms is to define the terms and conditions for online sale and delivery of the Products, as well as the rights and obligations of the parties in this context.

    They are accessible and printable at any time via a direct link at the bottom of the Site.

    They do not apply to the sale of Products to professionals.

    HYBRÉ reserves the right to modify these general terms and conditions of sale at any time. The applicable version is the one available online on the Site on the date of the Buyer's order, a copy of which is sent with the order confirmation.

    These terms and conditions prevail over any other general or special terms not expressly approved by HYBRÉ.

    They may be supplemented, if applicable, by special terms of use for certain Products or services offered on the Site, which complement these general terms and, in case of contradiction, shall prevail.



  • Seller Identity and Contact

  • The Site is operated by HYBRÉ, a simplified joint-stock company (SAS) registered with the Paris Trade and Companies Register under number 928 292 291, with registered office located at 42, Avenue Claude Vellefaux, 75010 Paris ("HYBRÉ"), which offers the Products for sale.

  • Legal Capacity and Acceptance of the Terms and Conditions

  • Legal Capacity

  • The Site is accessible to any individual with full legal capacity to commit under these terms and conditions. Individuals who do not have full legal capacity may only access the Site with the authorization of their legal representative.

    The Buyer qualifies as a consumer, defined as any natural person acting for purposes which are outside their trade, business, craft, or profession.



  • Acceptance of the Terms and Conditions

  • Acceptance of these general terms and conditions by the Buyer is indicated by checking the corresponding box in the order form. By doing so, the Buyer acknowledges having read and accepted these terms before placing an order. Acceptance is full and unconditional. Any conditional acceptance is considered null and void.

    Buyers who do not accept these terms must not place an order on the Site.



  • Product Features
  • Before placing an order online, the Buyer can consult the Site to review the characteristics of each Product they wish to purchase.

    The Products are offered for sale online while stocks last.

    Photographs and descriptions of the Products presented online are as accurate as possible. HYBRÉ is only bound by what is explicitly stated. The Buyer acknowledges and accepts that certain characteristics—particularly colors—may not exactly match the photos on the Site due to technical limitations.



  • Ordering

  • To place an order on the Site, the Buyer may register by filling out the dedicated form. However, account creation is not mandatory for placing an order.

    Registration automatically creates an account in the Buyer's name ("the Account"), used solely to manage purchases using a login and a one-time 6-digit verification code sent via email.

    The Buyer guarantees that all information provided in the registration or order form is accurate, up-to-date, truthful, and not misleading.

    The Buyer agrees to update their Account details in the event of changes (e.g., change of postal address) to ensure the information remains accurate.

    In all cases, the Buyer must provide all mandatory information. Incomplete registrations will not be validated.

    The Buyer is informed and accepts that the information entered for account creation or update constitutes proof of identity. Such entries are binding upon validation.

    The Buyer agrees to personally use their Account and not to allow any third party to use it in their place or on their behalf, accepting full responsibility if they do. They are also responsible for maintaining the confidentiality of their login and one-time code; any access to the Site using these credentials is presumed to have been made by the Buyer. The Buyer must immediately contact HYBRÉ if they suspect unauthorized use of their Account.

    The Buyer may also subscribe to HYBRÉ’s newsletter.



  • Order Placement

  • To place an order, the Buyer must select the Product(s) of their choice in the desired quantity and add them to their virtual shopping cart.

    The Buyer can review the contents of their cart at any time prior to finalizing the order and may correct any errors in the information entered.

    The order is considered received by HYBRÉ when it is accessible by them.



  • Order Confirmation

  • At the end of the order process, the Buyer will receive an order confirmation email which:

    • Summarizes the order details, the total amount paid, the applicable VAT rate and amount, and the estimated delivery time;

    • Includes the applicable general terms and conditions of sale on the date of the order;

    • Contains the invoice corresponding to the order.

    The Buyer must ensure that the contact details provided in their Account and during the order process are correct and allow them to receive the confirmation email. If the Buyer does not receive the confirmation, they must contact HYBRÉ using the contact details in the “Seller identity and contact” section.

    HYBRÉ recommends that the Buyer keeps the information contained in the order confirmation.

    The order confirmation is deemed received by the Buyer once accessible to them.


  • Prix et modalités de paiement

  • Product Prices

  • Product prices are displayed on the Site.

    Prices are indicated in euros, including all taxes.

    HYBRÉ reserves the right, at its sole discretion and under conditions it defines, to offer promotional discounts or price reductions.

    Prices do not include any applicable delivery fees, which will be charged in addition to the Product price. The amount of delivery fees will be shown before the Buyer confirms the order.

    The applicable price is the price displayed on the Site at the time the Buyer’s order is recorded.



  • Customs Duties and Local Taxes

  • Warning : Outside the European Union and in Overseas Departments and Territories (DROM-COM), customs duties or local taxes may be applicable and billed upon receipt of the package by the Buyer, in addition to the price paid to HYBRÉ.

    HYBRÉ cannot determine or inform the Buyer of the exact amount of such duties or taxes in advance.

    The Buyer remains responsible for the completion of all declarations and formalities related to such duties and taxes.



  • Payment Methods

  • The total price of the Products is payable upon order.

    Payment may be made online by credit card, through the secure payment service indicated on the Site, or by any other method proposed at the time of order.

    The Buyer guarantees that they have the necessary authorization to use the chosen payment method.

    HYBRÉ reserves the right to suspend or cancel any order and/or delivery in case of non-payment, payment incident, or fraud (or attempted fraud) related to the use of the Site.

    Late payments will incur penalties equal to one and a half times the legal interest rate applicable in France, automatically applied upon first formal notice by registered letter with acknowledgment of receipt.



  • Invoicing

  • Invoices will be sent to the Buyer by any appropriate means.


  • Retention of Title

  • HYBRÉ retains full ownership of the Products sold until full payment of the price, including delivery charges.


  • Delivery of Products

  • Delivery Area

  • The Site indicates, for each Product offered for sale, the possible delivery areas for that Product.

    Delivery of Products ordered on the Site will be made to the address indicated by the Buyer as the “delivery address” (which may differ from the billing address), provided it is located within the delivery area applicable to the concerned Products.


  • Delivery Methods

  • Different delivery methods may be available depending on the category and weight of the Products.

    The Buyer is informed before confirming the order of the available delivery methods for the ordered Product, as well as the corresponding delivery times and costs.

    The Buyer must select the desired delivery method and provide all necessary information for effective delivery according to that method.


  • Delivery Timeframes

  • The Site specifies, for each Product offered for sale, indicative delivery times depending on territories and delivery methods.

    The actual delivery timeframe will be confirmed to the Buyer in the order confirmation email.

    If the delivery is not made within the above timeframe, the Buyer may cancel the order by registered letter with acknowledgment of receipt or by other durable means, provided that after having given HYBRÉ formal notice by the same means to deliver within an additional reasonable timeframe, HYBRÉ has still failed to perform the delivery.

    The contract shall be considered canceled upon receipt by HYBRÉ of the letter or notice informing it of the cancellation, unless the delivery has been performed in the meantime.

    In case of cancellation of the contract under the above conditions, the Buyer shall be reimbursed the full amount paid, including delivery charges, within 14 (fourteen) days from the date the contract was terminated.

    HYBRÉ reserves the right to offer the Buyer alternative reimbursement solutions for the price of the Products and delivery fees. The Buyer must explicitly accept the alternative reimbursement method in writing on a durable medium.


  • Right of Withdrawal

  • The Buyer has a period of 14 (fourteen) days from the date of receipt of the ordered Products to withdraw without having to justify reasons or pay penalties, except for the return shipping costs which remain the Buyer’s responsibility. If the order consists of multiple Products delivered separately, the withdrawal period starts from the receipt of the last Product.

    To exercise the right of withdrawal, the Buyer must notify HYBRÉ at the contact details mentioned in the “Seller identity and contact” section before the withdrawal period expires, by sending the withdrawal form attached to these terms or any clear statement expressing the Buyer’s intention to withdraw, including the order number.

    Products must be returned to HYBRÉ in their original condition and packaging without undue delay and no later than 14 (fourteen) calendar days following the communication of the withdrawal decision by the Buyer. They must be accompanied by a copy of the corresponding purchase invoice. Products must be returned to the following address:

    Beyond this 14-day period, the sale is final and binding.

    Any Product opened or damaged by the Buyer will not be accepted for return and will not be refunded under any circumstances. The Buyer is responsible for any damage caused to the Products during their return to HYBRÉ.

    The Buyer will be refunded as soon as possible, and at the latest within 14 (fourteen) days from the date HYBRÉ receives the withdrawal request, the full amount paid for the order, less any return shipping costs, which remain the Buyer’s responsibility. HYBRÉ reserves the right to delay the refund until the Products are effectively recovered.



  • Legal Warranties

  • The Buyer benefits from the legal warranties against non-conformity and hidden defects of the sold goods, including defects resulting from the packaging of the Products ordered on the Site.

    If the Buyer notices that the delivered Product has a defect, non-conformity, or damage, they must inform HYBRÉ at the contact details provided in the "Seller’s identity and contact" section, specifying the nature of the defect, non-conformity, or damage, and providing any useful evidence, including photographs.

    HYBRÉ will arrange the return process with a carrier of its choice and will inform the Buyer by any suitable means. HYBRÉ will bear the cost of the return.

    Products must be returned in their original condition and packaging. Returns that do not comply with these conditions will not be accepted.

    After verification, HYBRÉ will offer the Buyer, whenever possible, a replacement of the Product. If replacement is impossible, HYBRÉ will reimburse the Buyer in full, including delivery costs, as soon as possible and no later than 14 (fourteen) days after informing the Buyer of this impossibility.



    Reminder of Consumer Code provisions:


  • The consumer has two years from the delivery date to invoke the legal warranty of conformity in case of non-conformity. During this period, the consumer only needs to prove the existence of the defect, not its date of appearance.

  • For digital content or services provided continuously for more than two years, the legal warranty applies throughout the duration of the provision.

  • The legal warranty of conformity obliges the professional to provide all necessary updates to maintain the conformity of the good.

  • The consumer is entitled to repair or replacement of the good within thirty days, free of charge and without major inconvenience.

  • If the good is repaired under this warranty, the initial warranty is extended by six months.

  • If the consumer requests repair but the seller imposes replacement, the legal warranty is renewed for two years from the date of replacement.

  • The consumer may obtain a price reduction or contract termination with full reimbursement if:
    1° The professional refuses to repair or replace the good;
    2° Repair or replacement occurs after thirty days;
    3° Repair or replacement causes major inconvenience to the consumer (definitive costs, etc.);
    4° The non-conformity persists despite attempts at compliance.

  • If the defect is serious, the consumer can immediately request price reduction or contract termination without prior repair or replacement request.

  • No right to termination exists if the defect is minor.

  • Any immobilization of the good for repair or replacement suspends the warranty period until the repaired good is delivered.

  • These rights arise from articles L.217-1 to L.217-32 of the French Consumer Code.



    A seller who maliciously obstructs the implementation of the legal warranty may face a civil fine up to €300,000 or 10% of the average annual turnover (article L.241-5 of the Consumer Code).

    Moreover, the Buyer benefits from the legal warranty against hidden defects, under articles 1641 to 1649 of the Civil Code, valid for two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if keeping the good or full reimbursement upon return of the good.




  • Obligations des Acheteurs

  • Buyers are solely responsible for the use they make of the Products. It is their responsibility to verify the suitability of the Products for their specific needs prior to purchasing said Products.

    They must also take the necessary measures to safeguard, by their own means, any information related to their Account that they consider necessary, as no copy will be provided to them.

    Finally, it is the responsibility of Buyers to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any harm.



  • HYBRÉ’s Liability

  • HYBRÉ commits to regularly check the operation and accessibility of the Site. To this end, HYBRÉ reserves the right to temporarily suspend access to the Site for maintenance reasons. Likewise, HYBRÉ cannot be held responsible for temporary difficulties or impossibilities of access to the Site caused by circumstances beyond its control, force majeure, or disruptions in telecommunications networks.

  • HYBRÉ cannot be held liable for non-performance or delays in the execution of sales contracts due to circumstances beyond its control or cases of force majeure as defined by Article 1218 of the French Civil Code.

  • The Buyer is also informed and accepts that any stock update error, regardless of origin, does not engage HYBRÉ’s liability, which provides no guarantee in this regard and cannot be held responsible for the cancellation of a Product order due to stock depletion.

  • HYBRÉ cannot be held liable for damages caused by misuse of products sold on the Site or failure to comply with usage precautions.

  • In any case, HYBRÉ’s liability under these terms is expressly limited to direct proven damages suffered by Buyers only.

  • Intellectual Property

  • Intellectual Property Rights of the Site

  • The systems, software, structures, infrastructures, databases, and any content (texts, images, visuals, music, logos, trademarks, databases, etc.) used by HYBRÉ on the Site are protected by all applicable intellectual property rights or database producer rights. Any disassembly, decompilation, decryption, extraction, reuse, copying, and more generally, any reproduction, representation, dissemination, or use of any of these elements, in whole or in part, without HYBRÉ’s authorization is strictly prohibited and may lead to legal action.


  • Intellectual Property Rights on Buyers’ Reviews

  • The Buyer may leave a review on the Product(s) they purchased and share their customer experience.

    Consequently, the Buyer consents that HYBRÉ may:

    • Reproduce, display, and publish the reviews free of charge on HYBRÉ’s Site and social media, and on any other French or foreign websites managed by companies with which HYBRÉ has agreements, by any means and on any media, for the purpose of advertising and promoting the Site and Products;

    • Translate the reviews into any language;

    • Modify (including framing, format, colors) and/or adapt the reviews (notably to technical constraints of the Site and other media or supports where the reviews are published, especially to prevent any alteration or quality degradation).


  • Personal Data

  • HYBRÉ undertakes to comply with all applicable legal and regulatory obligations regarding the protection of personal data, notably the French Data Protection Act No. 78-17 of January 6, 1978 as amended (“Informatique et Libertés”) and the EU Regulation 2016/679 of April 27, 2016 (GDPR).

  • Advertising

  • HYBRÉ reserves the right to insert on any page of the Site and in any communication to Buyers any advertising or promotional messages in any form and under conditions solely determined by HYBRÉ.



  • Links and Third-Party Sites

  • HYBRÉ cannot be held responsible for the technical availability of websites or mobile applications operated by third parties (including its possible partners) which the Buyer may access via the Site.

    HYBRÉ assumes no liability for the content, advertisements, products, and/or services available on such third-party sites and mobile applications, which are governed by their own terms of use.

    HYBRÉ is also not responsible for any transactions between the Buyer and any advertiser, professional, or merchant (including possible partners) to whom the Buyer may be directed via the Site and cannot be a party to any disputes with these third parties, notably concerning delivery of products and/or services, warranties, representations, or any other obligations these third parties may have.



  • Comportements prohibés

  • The following are strictly prohibited: (i) any behavior likely to interrupt, suspend, slow down, or prevent the proper functioning of the Site; (ii) any intrusion or attempted intrusion into HYBRÉ’s systems; (iii) any misuse of the Site’s system resources; (iv) any actions likely to impose a disproportionate load on the Site’s infrastructure; (v) any breach of security or authentication measures; (vi) any acts likely to harm the financial, commercial, or moral rights and interests of HYBRÉ or the users of its Site; (vii) any misuse of the Site for purposes other than those for which it was designed; and more generally (viii) any breach of these general terms and conditions or of applicable laws and regulations.

  • It is also strictly forbidden to barter, sell, or grant all or part of the access to the Site, as well as to the information it contains.

  • Any commercial exploitation of the Products by Buyers is prohibited, including any resale or distribution for profit.

  • In case of breach of any of the provisions of this article or more generally of violations of laws and regulations, HYBRÉ reserves the right to take any appropriate measures and to initiate legal proceedings.

  • Unsubscription

  • The Buyer may unsubscribe from the Site at any time by sending a request to HYBRÉ by email, using the contact details provided in the section "Identity of the seller and contact."

    The unsubscription will take effect within a maximum period of 15 (fifteen) days from the request.

    It will result in the automatic deletion of the Buyer’s Account.


  • Language

  • In the event of a translation of these general conditions into one or more languages, the French language shall prevail in case of contradiction or dispute regarding the meaning of any term or provision.



  • Registration on the Telephone Solicitation Opposition List

  • In accordance with Law No. 2014-344 of March 17, 2014, the Buyer is informed that, as a consumer under the Consumer Code, they have the option to register free of charge on the telephone solicitation opposition list BLOCTEL (www.bloctel.gouv.fr) in order to no longer be contacted by telephone by a professional with whom they do not have an ongoing contractual relationship.


  • Mediation

  • The Buyer has the right to free recourse to a consumer mediator for the amicable resolution of any dispute regarding the execution of these terms which may oppose them to HYBRÉ, under the conditions set out in Articles L611-1 and following of the Consumer Code.

    If the Buyer is a foreign consumer but located in the European Union, they benefit from the protection of the mandatory provisions of their country of residence. In case of dispute, the Buyer is encouraged to first contact HYBRÉ’s customer service to seek an amicable solution.

    If no agreement is reached, the Buyer may turn to national or European consumer dispute resolution mechanisms. The European Commission provides a page listing the relevant mechanisms and national contact points (mediation organizations, European Consumer Centres, FIN-NET, etc.), accessible here.



  • Governing Law

  • These general terms and conditions are governed by French law.
